Several cities across the United States require tour guides to have licenses. In New Orleans and the District of Columbia, tour guides challenged this requirement on the basis that their First Amendment rights were being violated. Federal courts of appeal have split on the constitutionality of the licensing requirement. This Comment analyzes the two cases that have decided the issue and argues that the licensing requirement is unconstitutional.
