Symposium on Presidential Control of Rulemaking: An Introduction

Introduction by Paul R. Verkuil

This symposium brings together a group of thoughtful lawyers to address a fundamental question of administrative law: Whether, and if so, how, the President should control policy outcomes in agency rulemaking. The topic is timely because the last two Administrations have inserted the White House directly into the agency decision process as part of an overall economic strategy to reduce inflation and enhance productivity. There are indications that long dormant questions of institutional competence and power will have to be resolved soon, either legislatively or judicially.
