This Comment investigates the nature of the actio Publiciana of Roman law. The actio Publiciana provides the foundation for a comparison between pre-Pure Oil Co. Louisiana jurisprudence and the Publician actions of France and Greece. The comparison leads to a legislative proposal to alleviate the probatio diabolica by reinstating the pre-Pure Oil Co. jurisprudence as a Louisiana Publician action.
