The question of why blackmail is prohibitable has puzzled a wide variety of commentators. Because nothing close to a consensus opinion has emerged, the issue of blackmail and its criminalization is ripe for review. This Comment briefly evaluates the existing blackmail scholarship and then makes a critical examination of one of the newest theories in the blackmail debate. It concludes with a determination that the crime of blackmail is irreconcilable with common notions of liberal society.
