A Primer on the Class Action Fairness Act of 2005

Congress passed the Class Action Fairness Act of 2005 (CAFA) to address reports of class action abuses that developed over the past decade. Although the Act is approaching its first anniversary, it is still too soon to measure its impact on the legal landscape. This Article will examine the basic features of CAFA, discuss some of the developing case law under the statute, and then offer some observations about how CAFA might affect the management of complex litigation.
