The United States Court of Appeals for the Fifth Circuit held that a district court's denial of a special motion to strike is immediately appealable under the collateral order doctrine and that the plaintiff had failed to demonstrate a probability of success on the merits, reversing the district court's ruling. Henry v. Lake Charles American Press, L.L.C., 566 F.3d 164, 181-82 (5th Cir. 2009).
