After the Fifth Circuit's decision in Hassen v. Ruston Louisiana Hospital Co., 932 F.3d 353 (5th Cir. 2019), employers defending allegations of discrimination face a relatively lenient standard for justifying their decisions. This Note questions the majority's leniency on what constitutes a consistent explanation and endorses the dissent's stricter standard for employers' explanations for potentially discriminatory decisions.
