Parish of Plaquemines v. Chevron USA, Inc.: Fifth Circuit Panel Unanimously Votes Oil Companies' Removal Filing is Too Little, Too Late and Keeps Forty-Two Pollution Lawsuits in State Court

In Parish of Plaquemines v. Chevron USA, Inc., the Fifth Circuit's brief en banc decision ended a years-long procedural battle over which court will decide if hundreds of oil companies will be held liable for allegedly illegal coastal oil drilling. This Note argues that although the court departed from established removal precedent, the court’s decision is consistent with environmental policy and will likely lead to effective pollution management at the state level.
